Limit Of Liability

Classification Details - General Practitioner (Non-Procedural)
This policy would not provide indemnity to the Insured for claim(s) made against him/her arising out of any procedures listed as follows:

1. Assisting at Surgery
2. Lumbar Puncture for Diagnosis only
3. Removal of foreign bodies from eye under local anaesthetic
4. Removal of ingrown toenails (but no Zadek Procedures)
5. Removal of lipomas under local anaesthetic
6. Removal of subcutaneous cysts under local anaesthetic
7. Repair of superficial skin lacerations (not involving muscles or tendons)
8. Incision and Drainage under local anaesthetic
9. Circumcision
10. IUCD Insertion and Removal
11. Cortisone Injections
12. Emergency reduction of fracture /dislocation of joints not requiring general anaesthetic


For the purpose of this Policy, the term Medical Professional Services would exclude:

(i) any diagnosis, treatment and care practiced with specialized skill in any of the following medical specialties classified under the National Specialist Register of Malaysia:

Anaesthesiology; Cardiothoracic surgery; Emergency medicine; Forensic pathology; General medicine; Neurosurgery; Nuclear medicine; Obstetrics and Gynaecology; Oncology; Ophthalmology; Orthopaedic surgery; Otorhinolaryngology; Paediatrics; Paediatric surgery; Pathology; Plastic surgery; Psychiatry; Radiology; Rehabilitation medicine; Sport medicine; Surgery; Transfusion medicine; Urology;

(ii) termination of pregnancy;
(iii) any clinical trial or research activities whether or not the Insured acting as clinical research organiser, clinical trial investigator or otherwise; or
(iv) manufacture or marketing of any drug, medical device, supplement or any product.
Classification Details - General Practitioner (Procedural)
General Practitioners procedures limited to:

1. Assisting at Surgery
2. Lumbar Puncture for Diagnosis only
3. Removal of foreign bodies from eye under local anaesthetic
4. Removal of ingrown toenails (but no Zadek Procedures)
5. Removal of lipomas under local anaesthetic
6. Removal of subcutaneous cysts under local anaesthetic

8. Incision and Drainage under local anaesthetic
9. Circumcision
10. IUCD Insertion and Removal
11. Cortisone Injections

Classification Details - Dental Practitioner (Non-Maxillofacial)
Maxillofacial procedures to be defined as following:

a) any maxillofacial procedure including but not limited to:
  • extra oral procedures to face, head, neck including partial thyroidectomies,
  • open reduction of zygomatic complex fractures,
  • excision of maxilla,
  • Hemimaxillectomy for malignancy,
  • Osteotomies (maxilla and/or mandible),
  • Prosthetic replacement of temporomandibular joints including arthroplasty,
  • Reconstruction with axial and micro-vascular flaps,
  • Neck surgery including block dissection of cervical lymph nodes,
  • Surgical treatment of thyroid and parathyroid glands,
  • Surgery involving the orbital complex,
  • Rhinoplasty (other than immediate trauma aftercare),
  • Facial cosmetic surgery (including face lifts, dermabrasion, otoplasty, blepharoplasty and liposuction); or

b) the performance of aesthetic dentistry where the primary purpose is the alteration of the external appearance of a patient for non-therapeutic reasons.
The following specialists are excluded:
  • Pedodontist or Pediatric Dentist
  • Orthodontist
  • Periodontist
  • Endodontist
  • Prosthodontist

Medical Malpractice Insurance Benefits
Good Samaritan Act

Cover any Claim arising from the rendering of emergency first aid assistance to any person without remuneration, at the scene of an accident, medical crisis or disaster not in the Insured's medical professional capacity but as a bystander, and such first aid assistance took place

Coroner’s Inquest

Cover reasonable and necessary costs, charges, fees and expenses incurred by the Insured arising from a Coroner’s Inquest

Manslaughter Defence Costs

Cover the Insured in respect of defence costs incurred with the prior written consent of the Insurer in the defence of any criminal proceedings brought for manslaughter arising from the provision of Medical Professional Services

Libel and Slander

Cover any Claim against the alleging any libel or slander by the Insured spoken or written or allegedly spoken or written. )

Estates and Legal Representatives

Indemnify the estate, heirs or legal representatives of the Insured if such Insured dies or becomes mentally incompetent, to the extent that the Insurer would otherwise have been liable to indemnify the Insured.

Extended Reporting Period

If the Insured retires or ceases to practise as an general practitioner or dentist and has been insured by the Insurer for at least five (5) years, the Insured shall have the right to purchase an Extended Reporting Period of six (6) years.

Medical Council Inquiry

Cover reasonable and necessary costs, charges, fees and expenses incurred by the Insured

Vicarious Liability

Cover any Claim first made against the Insured arising from negligence committed in Malaysia in the provision of Medical Professional Services by an employee of the Insured or a locum acting on behalf of the Insured and for whose negligence the Insured is legally liable.

Fraud and Dishonesty

Cover any Claim first made against the Insured brought about or contributed to by any fraudulent or dishonest conduct of an employee of the Insured in relation to Medical Professional Services committed in Malaysia

Loss of Document

Cover any Claim against the Insured for destruction, damage to, loss, erasure or mislaying of Documents while in the physical custody or control of the Insured for the purpose of provision of Medical Professional Services in Malaysia and for which the Insured is legally responsible.
